Actually Spikey I'm pretty sure it's the cracking of CSS that's dubbed illegal and not the copying of the disc, and running your DVD player through something like a TBC to strip off Macrovision isn't against the law.
It's the violation of the DMCA's laws that prohibit software that allow you to get around protection systems that's the problem.
In an industry where a products like Kaleidescape are becoming more and more popular (and more and more under assault), CI's should be more concerned about things like the DMCA or the Broadcast Flag, than some Joe Six Pack looking to make a backup of his DVD's.
If it were for being able to backup DVD's, I'd have had to buy 20 copies of the same damn Wiggles DVD. Instead, my 2 year old can destroy the DVD-R backups while I rest assured that the original is tucked safely away in a shelf far from his reach.
