In short, even with One Party consent states. The recording of audio to keep the nanny in check would be illegal. Unless they are the party that knows about it. But seeing how it's the home owner who wants it installed, I can assume the nanny will not know about it.

So you, as the installer/business owner, may want to ask a local lawyer what to do. Meaning if you should have the lawyer draft up a letter stating that you will not get in trouble in any way, shape or form if shit hits the fan. As you were just the installer.

In most states you can secretly video tape even private areas in your own home as long as the people recorded aren’t minors. But adding audio to it changes everything.

Some states don't want recording done without a damn good reason by private people, or a warrant if it's law enforcement. Others require that at least one party know that the recording is taking place. Many states don't allow recording when none of the parties are aware of it but nanny cams are allowed. If there's an expectation of privacy (restrooms, etc), they don't like to allow it.

Next time you use an elevator, look in the upper corners and at the control panel- in public buildings, you're gonna see at least one camera and in buildings where security is required, ditto.
