I’m voluntarily leaving a small company in FL in the next week or two for a new job. The owner has cut my commissions short claiming profitability fell short of expectations. I am due over $30K based on my estimates. Over the past 12 months he has set a precedent by paying me 10% of revenue on smaller jobs ranging from $2K to $25K. (I have these statements) In 2010 my sales efforts directly lead to a large $300K job. After repeated inquiries, he is offering me a small “finders fee” (yet to be determined) but he says certainly NOT 10%. I am a salaried employee with a bonus plan > the bonus plan is a hand shake agreement so my legal actions are limited.

I saw an earlier post where someone suggested a complaint to the Better Business Bureau or the Attorney General's office might "nudge" them enough to do-the-right-thing. Suggestions???

Without a written agreement i doubt there is anything you can do about it. $30k as you are walking away from the company?

To clarify.. i am not saying that you shouldn't get what you agreed to. I am saying that if you were not leaving it would be more likely that he would honor the agreement.

Also.. im confused here. $30k is the 10% from the $300k project? Or commission on the other projects? Does he owe you $30k or $60k?

You should post this in the Custom Installers Forum here. If you are really owed that kind of money i certainly wouldn't be quiet about it. But like i said.. you are salary and you have no written agreement. Whats to stop him from saying "i never made any such agreement"? His word vs yours means its a wash.
